Terms of Service – Tank N Trench

By hiring or engaging Tank N Trench for excavation, dirt hauling, septic installation, or related services, you agree to the following terms:
1. Service Scope
Work to be performed will be clearly outlined in an agreed-upon estimate or contract. Any additional work requested after project start may require an updated quote.
2. Payment Terms
Payment is due upon completion unless otherwise stated in writing. A deposit may be required for materials or large projects. Late payments may incur a fee of 2% per month.
3. Site Access
Client agrees to provide reasonable access to the property, including driveways, gates, and easements necessary for heavy equipment and material delivery.
4. Permits & Regulations
Tank N Trench will assist with obtaining permits when necessary, but the client is ultimately responsible for ensuring that work is compliant with local building codes and regulations unless otherwise agreed in writing.
5. Liability & Damage
We are fully insured. However, we are not liable for damage to unmarked underground utilities or structures unless clearly disclosed before work begins.
6. Project Delays
Delays due to weather, site conditions, or client-caused postponements may affect timelines. We will communicate promptly and adjust schedules as needed.
7. Warranties
Septic system installations may include a limited workmanship warranty. Other services are covered by general industry standards. Specific warranty terms are outlined in your individual service agreement.
8. Cancellation Policy
Cancellations must be made at least 72 hours in advance. Deposits may be forfeited for short-notice cancellations.
9. Right to Refuse Service
Tank N Trench reserves the right to refuse service for any reason, including unsafe site conditions, non-cooperative behavior, or payment history.
Conditions
Free Estimates
Tank N Trench offers free estimates for most standard excavation, septic, and grading services within our normal service area. However, we reserve the right to charge a consultation or travel fee under the following conditions:
The job site is located outside of our standard operating zone (beyond 15 miles from Perris, CA).
The customer requests in-depth consultation, design advice, or site analysis beyond the scope of a basic quote.
The estimate request occurs on a weekend, holiday, or during an after-hours/emergency call-out.
All fees, if applicable, will be disclosed and approved by the customer before scheduling.
Site Conditions
All services are contingent on the customer providing reasonable access to the job site. This includes the removal of any obstructions, clearance for equipment, and an accurate understanding of underground utilities or hazards. Tank N Trench is not responsible for delays or damages resulting from unknown site conditions unless previously disclosed.
Weather & Delays
Work is subject to weather and soil conditions. In cases of heavy rain, flooding, or hazardous working conditions, services may be rescheduled for safety and efficiency. Customers will be notified promptly, and all efforts will be made to minimize disruption.
Permits & Compliance
It is the customer's responsibility to confirm whether permits are required for excavation or septic-related work unless Tank N Trench has been contracted to handle permitting. We are not liable for delays or fines resulting from missing or incorrect permit documentation when handled by the customer.
Underground Utilities & Customer-Provided Information
Tank N Trench relies on the accuracy of the information provided by the customer regarding underground utilities, including but not limited to electrical lines, gas lines, water mains, septic systems, irrigation lines, or communication cables.
If the customer states that no such utilities exist underground and excavation reveals otherwise, Tank N Trench is not responsible for:
Any damage to unidentified or misrepresented underground infrastructure
Delays caused by the discovery of such utilities
Additional costs incurred as a result of altered plans, equipment changes, or utility mitigation
It is the customer’s responsibility to either verify utility locations in advance or request utility locating services. Tank N Trench can coordinate with utility marking services upon request but is not liable for their accuracy or timeliness unless explicitly contracted to manage that portion of the project.
